Q1. Write a note on the
international regime on access and benefit sharing.
Access and
Benefit Sharing (ABS) is a pivotal component of international biodiversity
governance, aimed at ensuring fair and equitable distribution of benefits
arising from the utilization of genetic resources. The framework acknowledges
that biological resources, such as plants, animals, and microorganisms, are
essential for various purposes including pharmaceuticals, agriculture, and
biotechnology. However, their use can raise ethical, legal, and economic
concerns, particularly regarding the rights of indigenous and local communities
who often hold traditional knowledge about these resources.
The Convention
on Biological Diversity (CBD), established in 1992, serves as the cornerstone
for ABS efforts at the international level. The Nagoya Protocol, adopted in
2010 under the CBD, is the primary instrument governing ABS. It provides a
comprehensive framework for the fair and equitable sharing of benefits derived
from the utilization of genetic resources, while also promoting conservation
and sustainable use.
Key principles
of the Nagoya Protocol include:
Sovereignty:
Recognizes the sovereign rights of states over their genetic resources.
Prior Informed
Consent (PIC): Requires that access to genetic resources is subject to prior
informed consent of the providing country or indigenous community.
Mutually Agreed
Terms (MAT): Specifies that the terms of access and benefit sharing must be
mutually agreed upon between the provider and the user of genetic resources.
Benefit
Sharing: Ensures that benefits arising from the use of genetic resources are
shared fairly and equitably with the countries and communities that provided
them.
Compliance:
Establishes measures to ensure compliance with ABS regulations and encourages
the development of domestic ABS frameworks.
Implementation
of the Nagoya Protocol involves national legislation and institutional
frameworks to operationalize ABS provisions at the domestic level. This
includes the establishment of competent national authorities, access permits,
benefit-sharing agreements, and monitoring mechanisms.
Despite
progress in ABS implementation, challenges remain. These include capacity
building in developing countries, addressing issues related to intellectual
property rights, fostering cooperation between governments, industry, and
indigenous communities, and ensuring effective enforcement mechanisms.
In conclusion,
the international regime on access and benefit sharing, anchored by the Nagoya
Protocol, represents a significant step towards the conservation of
biodiversity and the equitable sharing of benefits derived from genetic
resources. By promoting transparency, cooperation, and respect for traditional
knowledge, ABS endeavors to strike a balance between conservation goals and the
sustainable use of biological resources for the benefit of present and future
generations.
