⟩ How to Build Your Case-Law
Analysis
For every
judgment you shortlist, make a brief note before you write a single line of
your project. This note-taking step is what separates original analysis from a
copied case summary:
1.
Facts —
what actually happened, in 2–3 lines.
2.
Issue —
the specific legal question the court had to answer.
3.
Arguments —
what each side argued, briefly.
4.
Holding —
what the court decided, and on what reasoning.
5.
Your Analysis —
how this case fits your topic's larger theme, and whether you agree with the
reasoning.
