Non-deceptiveness: The sign should not mislead consumers
about the nature, quality, or origin of the goods or services.
Not prohibited: The sign should not consist exclusively of
signs or indications which may serve, in trade, to designate the kind, quality,
quantity, intended purpose, value, geographical origin, or the time of
production of the goods or rendering of the service, or other characteristics
of the goods or services.
Non-functional: The sign should not be functional in nature;
it should not be essential to the product or service itself.
Not immoral or scandalous: The sign should not be contrary
to morality or public order.
Meeting these requirements ensures that a trademark is
capable of fulfilling its primary function, which is to identify the source of
goods or services and to distinguish them from those of competitors in the
marketplace.
