Q1. Critically analyse the various rights guaranteed to Persons with Disabilities under the Convention on the Rights of Persons with Disabilities, 2006.
The Convention on the Rights of Persons with Disabilities (CRPD), adopted by
the United Nations in 2006, is a landmark international treaty that seeks to promote,
protect, and ensure the full and equal enjoyment of all human rights and
fundamental freedoms by persons with disabilities. It recognizes that persons
with disabilities are entitled to the same rights as everyone else and
establishes a framework for their inclusion and participation in all aspects of
society. The CRPD outlines various rights guaranteed to persons with
disabilities, and a critical analysis of these rights reveals both strengths
and areas for improvement:
Equality and
Non-discrimination: The CRPD emphasizes the principle of equality and prohibits
discrimination against persons with disabilities in all areas of life. It
mandates that persons with disabilities should enjoy all human rights and
fundamental freedoms on an equal basis with others, without discrimination of
any kind. This provision is crucial in promoting the full inclusion and
participation of persons with disabilities in society.
Accessibility:
The CRPD recognizes the right of persons with disabilities to access the
physical environment, transportation, information, and communication

the diverse needs of all learners, including persons with disabilities. While
progress has been made in promoting inclusive education, significant challenges
persist, including the lack of trained teachers, inaccessible school
facilities, and attitudinal barriers.
Employment: The
CRPD emphasizes the right of persons with disabilities to work, on an equal
basis with others, in an inclusive labor market. It calls for reasonable
accommodations and support services to ensure the full participation of persons
with disabilities in employment. However, persons with disabilities continue to
face barriers in accessing employment opportunities, including discrimination,
lack of accessibility, and inadequate support services.
Independent
Living and Community Inclusion: The CRPD recognizes the right of persons with
disabilities to live independently and be included in the community. It calls
for the provision of support services, such as personal assistance, to enable
persons with disabilities to live independently and participate fully in
community life. However, many persons with disabilities still face
institutionalization and segregation, rather than being supported to live
independently in the community.
Legal Capacity
and Access to Justice: The CRPD reaffirms the legal capacity of persons with
disabilities on an equal basis with others and calls for the provision of
support services to exercise legal capacity effectively. It also emphasizes the
right of persons with disabilities to access justice on an equal basis with
others, including through the provision of accessible legal procedures and
accommodations. However, many persons with disabilities continue to face
barriers in accessing justice, including lack of access to legal aid and
inaccessible court facilities.
In conclusion,
