Q1. What is public
interest litigation (PIL)? Analyse some of the landmark judgements which enlarged
the scope of fundamental rights.
Public Interest Litigation (PIL) is a legal mechanism that allows individuals or groups to initiate legal proceedings in a court of law on behalf of the public interest or in the interest of a particular group of people who are unable to approach the court themselves due to various reasons, such as poverty, social disadvantage, or lack of awareness about their rights. PIL aims to promote justice, equality, and good governance by addressing issues that affect a large section of society.
Hussainara
Khatoon v. Home Secretary, State of Bihar (1979): This case was one of the
earliest PIL cases in India. The Supreme Court took suo moto cognizance of news
reports regarding the prolonged detention of undertrial prisoners in Bihar
jails. The court held that the right to a speedy trial is implicit in the right
to life and personal liberty under Article 21 of the Indian Constitution. This
judgment led to the release of thousands of undertrial prisoners who had been
languishing in jails for years without trial.
Bandhua Mukti
Morcha v. Union of India (1984): In this case, the Supreme Court addressed the
issue of bonded labor, which was prevalent in various parts of India despite
being prohibited by law. The court widened the scope of Article 21 to include
the right to live with human dignity. It held that bonded labor is a form of
forced labor and a violation of fundamental rights. The judgment emphasized the
duty of the state to ensure the abolition of bonded labor and the
rehabilitation of bonded laborers.
Vishaka v.
State of Rajasthan (1997): This case dealt with the issue of sexual harassment
of women in the workplace. The Supreme Court, recognizing the inadequacy of
existing laws to address this issue, laid down guidelines to prevent sexual
harassment at the workplace. The court held that sexual harassment violates the
fundamental rights of women to equality and dignity under Articles 14, 15, and
21 of the Constitution. This judgment led to the enactment of the Sexual
Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act,
2013.
Olga Tellis v.
Bombay Municipal Corporation (1985): In this case, the Supreme Court addressed
the issue of eviction of pavement dwellers in Mumbai. The court held that the
right to livelihood is an integral part of the right to life under Article 21
of the Constitution. It ruled that eviction without providing alternative
accommodation would violate the fundamental rights of the pavement dwellers.
This judgment emphasized the importance of balancing development with the
protection of the rights of marginalized communities.
M.C. Mehta v.
Union of India (1987): This case, commonly known as the Taj Trapezium case,
dealt with environmental pollution in the vicinity of the Taj Mahal. The
Supreme Court, invoking the doctrine of public trust and the principle of
sustainable development, directed various measures to mitigate pollution and
protect the environment. The court held that the right to a clean environment
is a fundamental right under Article 21 of the Constitution. This judgment laid
the foundation for environmental jurisprudence in India.
