SECTION I
Q1) Discuss the constitutional dimensions of decentralisation in India.
Decentralization
in India has significant constitutional dimensions, primarily enshrined in the
73rd and 74th Amendments to the Constitution, which were passed in 1992. These
amendments aimed to strengthen local self-governance by establishing a
three-tier system of Panchayats at the village, intermediate, and district
levels in rural areas, and Municipalities at the urban level.
Constitutional
Recognition: The 73rd and 74th Amendments added two new parts, namely the IX
and IX-A, to the Indian Constitution, explicitly recognizing Panchayats and
Municipalities as institutions of self-government. This constitutional
recognition ensures their autonomy and mandates their existence.
Distribution
of Powers: The Constitution delineates the powers and functions of Panchayats
and Municipalities. While the State Legislature has the authority to devolve
powers and responsibilities to these local bodies, certain subjects like land
revenue, local taxation, and public health are specifically assigned to them.
This distribution of powers ensures a clear delineation of responsibilities
between the different tiers of government.
Election and
Composition: The Constitution mandates regular elections to Panchayats and

marginalized sections such as women, Scheduled Castes (SCs), and Scheduled
Tribes (STs) through reservation of seats.
Finance
Commission: The Constitution also mandates the appointment of State Finance

Accountability
and Transparency: The Constitution emphasizes the importance of transparency
and accountability in local governance. It requires the preparation of budgets,
maintenance of accounts, and conducting regular audits to ensure that public
funds are utilized efficiently and judiciously.
Constitutional
Safeguards: The Constitution provides certain safeguards to protect the
interests of local bodies. It prohibits the dissolution of Panchayats or
Municipalities before the completion of their term except under specific

Inter-Governmental
Relations: Decentralization in India necessitates effective coordination and
